Terms and Conditions for Vacations & Travel magazine’s competition:

Your chance chance to WIN a four-night vacation in Fiji

By entering the ‘Your chance to WIN a four-night vacation in Fiji’ competition, you are agreeing to the following Terms and Conditions:

  1. Information on how to enter this competition and the prizes form part of the Terms and Conditions.
  2. The Promoter is Where Australia Pty Ltd.
  3. The competition commences on 01 April 2016 and concludes on 30 June 2016 (the ‘Promotion Period’).
  4. Entries will be judged commencing 01 July 2016 at 10:00 AEST at Where Australia office, F16, 1-5 Barr Street, Balmain, NSW 2041 Australia and the winner will be notified by email within 14 days.
  5. Prize is valid for two persons and entry is open worldwide, to persons aged 18 years or older only.
  6. To be eligible to win the Major Prize, individuals are required to provide an answer in twenty five (25) words or less to the promotional question – Tell us in 25 words or less “Why you would love to win a stay at InterContinental Fiji Golf Resort & Spa?” and submit the fully completed online entry form plus optional survey.
  7. All entrants will be subscribed to receive Vacations & Travel magazine’s email newsletter which is sent fortnightly (subject to change) and will receive special offers from InterContinental Fiji Golf Resort & Spa via email. Remaining subscribed to these newsletters during the competition period forms part of these terms and conditions of entry.
  8. A limit of one (1) entry per person is permitted. All entries must be received within the Promotion Period.
  9. This is a game of skill and chance plays no part in determining the winners.
  10. The best valid entry, as selected by the judges based on creativity and originality or the answer to the promotional question will win the major prize (“Major Prize”) valued at up to AU$3,000 (depending on date & season)
  11. All elements of the prize are subject to availability at time of booking and black-out dates apply.
  12. The prize is valid to be used and must be completed by 30 June 2017. If, for any reason, a winner does not take the prize and complete the relevant holiday before that date or, once the prize has been booked, take the prize or an element of the prize by the date stipulated, then the prize or that element of the prize will be forfeited without further compensation.
  13. Accommodation prize is based on a Garden View room and must be taken on consecutive nights.
  14. All other expenses, not specifically stipulated in the prize package as an inclusion, remain the responsibility of the prize winner and their nominated travel companion as incurred, including but not limited to: airfares; spending money; additional meals (other than those included); taxes (except where otherwise stated); additional travel and transfers; items of a personal nature; in-room charges; gratuities; optional activities and any other ancillary costs, including but not limited to, insurance and any applicable insurance excesses.
  15. Prize winners should be satisfied that their chosen insurance cover fully meets their personal requirements especially in respect to inclement weather, personal injury or illness.
  16. In the event that a prize(s) (or part of any prize) is/are not available, InterContinental Fiji Golf Resort & Spa reserves the right to substitute prize(s) (or part of any prize) in its discretion to the same and equal recommended retail value and/or specification. All tours are subject to availability and weather conditions permitting.
  17. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash
  18. Employees (and their immediate families) of The Promoters, the prize sponsors and their associated agencies and companies associated with the competition are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  19. The Promoters accept no responsibility for any late, lost or misdirected entries including entries not received by the Promoters or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
  20. All entries submitted become the property of the Promoters. Entries will not be returned to any entrant. As a condition of entering this competition, each entrant licences the Promoters to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoters that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoters against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
  21. Incomplete, indecipherable or incomprehensible entries will be deemed invalid.
  22. The Promoters reserve the right to, at any time, request the winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim their prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoters. In the event that the winners cannot provide suitable proof, the winners will forfeit their prize in whole and no substitute will be offered.

  1. Should an entrant’s contact details change during the Promotion Period, it is the entrant’s responsibility to notify The Promoters. A request to access or modify any information provided in an entry should be directed to The Promoter.
  2. The Promoters’ decision is final and binding and the Promoters will not enter into correspondence regarding the competition result.
  3. The Promoter reserves the right to refuse to allow the winner and/or his/her travelling companion to take part in any or all aspects of the prize if the Promoter determines in its absolute discretion that the winner and/or his/her guest are not in the mental or physical condition necessary to be able to safely participate in the prize.
  4. The Promoters reserve the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoters, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions or who has, in the opinion of the Promoters, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or the Promoters. The Promoters reserves the right to disqualify a winner if the Promoters become aware that the winner and/or the winner’s entry are of a type described in this clause.
  5. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoters’ ability to proceed with the competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, The Promoters may, at their absolute discretion, suspend, modify or cancel the competition, as appropriate.
  6. The Promoters and the prize sponsors shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize, except for any liability which cannot be excluded by law.
  7. 29. Entrants consent to The Promoters using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by The Promoters.
  8. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  9. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
  10. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.
  11. The Promoters collect personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoters may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoters. All entries become the property of the Promoters.
